1. Purpose

These Terms govern the Services provided by Noteracker (the "Company"). These Terms comply with KR, US, UK laws and the regulations of global payment gateways (Eximbay, PayPal, etc.).

2. Right to Refuse/Terminate Service

The Company may refuse or terminate services if illegal content, fraud, or IP infringement is detected.

3. Intellectual Property and Licensing

1) Custom Orders: Ownership transfers to the User upon full payment.
2) Rebuilding & Security: The User is granted a perpetual, worldwide, non-exclusive, and transferable license for Company-modified code.
3) Resale and Transfer: The User may commercially operate and transfer the website to third parties.
4) Third-Party Licenses: Fees for plugins/themes are the User's responsibility and may be limited to one-year terms.

4. Payment and Currency

1) Payment: Processed through Portone via NicePay, KakaoPay, Eximbay, PayPal, etc.
2) Currency: KRW (domestic), USD/Local Currency (international). Exchange rates apply.

5. Refund Policy and Legal Basis

1) Customized Services (Development, Rebuilding, Maintenance):
- Non-Refundable Policy: These are "Made-to-Order" services where work begins immediately upon payment. No refunds are available after 24 hours of payment or once production has commenced.

- Republic of Korea: Under the "Electronic Commerce Act," right of withdrawal is limited as services are individually produced per order, and work is deemed to have commenced immediately.

- United Kingdom: Under the "Consumer Rights Act 2015," the 14-day right to cancel is waived once the User is notified of the commencement of "Personalised" services.

- United States: Under the "UCC" and consumer protection regulations, "Custom-made" services are non-refundable once performance has started.

2) Subscription Products:
- Cooling-off Period: A full refund is available within 7 days of purchase, provided no services have been utilized.
- Mid-term Cancellation: Refund = `Total Paid - (Months Used × Standard Rate) - Cancellation Fee (10% of remaining balance)`.

3) Digital Content: Non-refundable once files are transmitted or downloaded.

6. Limitation of Liability

1) DISCLAIMER: THE SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES.
2) CAP: LIABILITY IS CAPPED AT THE AMOUNT PAID DURING THE PRECEDING 12 MONTHS, SUBJECT TO LOCAL MANDATORY LAWS (E.G., UK CONSUMER RIGHTS ACT).

7. International Disputes and Governing Law

1) These Terms are governed by the laws of the Republic of Korea.
2) This shall not deprive international Users of their legal rights to bring proceedings in their own country as provided by mandatory local statutes.
